Fraley Auction Company, ("The Auctioneer") will offer for sale by auction ("The Auction") of items ("Items") either singularly or in groups ("Lot").
It is agreed that each Bidder Number/Username is unique and non-transferable. Bidders are to be held personally liable for any bids made with their Bidder Number. PLEASE DO NOT log in if you don’t plan to bid. You can watch as a GUEST. If you ACCIDENTALLY bid on an item because the Bidder screen was on, you WILL BE RESPONSIBLE to pay for that item. The Auctioneer reserve the right to revoke a Bidder Number at any time for any reason.
There will be a Buyers Premium charged on every lot purchased online. The Buyers Premium is 7%. Applicable State Sales Tax will be charged on all Lots if advertised as charging Sales Tax. We MUST charge Sales Tax if you can not prove you are tax exempt. Bidders will be exempt from Sales Tax if they provide proof of an approved tax exemption status form and exception certificates that are acceptable to the said State.
Payment in full must be made by Cash, Good PA Check (Out of State buyers paying with check need bank letter of credit), wire transfer (contact office for information and fee) and all major credit cards (fee associated with credit card use). PAYMENT MUST BE MADE in 2 BUSINESS DAYS AFTER SALE.
The Auctioneers have described the Lot(s) in the catalog to the best of their ability and belief from information furnished by the Seller(s). The Auctioneer undertake no liability whatsoever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. EACH AND EVERY LOT IS SOLD “AS IS, WHERE IS" with NO WARRANTY. It is the BIDDERS responsibility to determine the condition of the property and ask questions when needed. Any intending Purchaser must satisfy himself by inspection or otherwise as to the correctness of each such statement. The Buyer of a Lot is deemed to have inspected the item contained in that Lot prior to purchase.
After a bidder has won the item, they have become the new owner of the item. The Auctioneer or Seller are not responsible to provide any type of protection to item other than normal protection (locking the door to a vehicle for example) or insurance on items bought.
All purchases must be removed from the premises as specified by the Auctioneer. Failure to do so may result in storage fees and transportation fees if such purchases need to be moved to another location. The Bidder acknowledges responsibility for any personal injury or property damage caused by the Bidder or his/her agent during pickup. The Bidder also agrees to hold The Auctioneer, Auctioneer Agents or Seller harmless from any personal injury to himself/herself or agent and any property damage incurred on auction premises during pickup. The Auctioneer DOES NOT provide shipping services.
